Hello guys. I have something to confess. I am finding it hard to keep lying by posting here and as you may have noticed in the last few months I have rarely been here. In turn this is hurting my motivation for Peing. Well the truth is.

I am not 18.

In truth I am 17 turning 18 in October. I am sick of lying. Now I am here to apologise. I am sorry for lying to you all and am sorry to Matt for disobeying his number one rule. To be honest I can not believe that I have kept up the lie for this long. I hope you guys can find it in your heart to forgive me, I know you will probably feel a little betrayed and im sorry. I probably wont be allowed to come back here when I am actually am 18 so I have to say one last thing before I go.

You guys are all great people. There has been so many different personalities and it is amazing that everyone here are just really nice people. I will miss the conversations and the people on this forum greatly.

As for me I am 17 and am going through my last year of high school. I will definately continue my PE and hopefully gain some more.

That is so wierd. I was reading Shinobi's 'goodbye' post yesterday and it was so similar to this. I find it hard to belive that under age people confess about it to anyone - they shouldn't ever confess, not to nightclub bouncers, not to chicks, not to strip clubs, not to cops and as for on a forum where no one can see what you look like, for the record they should definately confess on that. Considering the anonymity of the nature of this 'online community' structure, I don't see how the forums can become liable for something unless someone confesses and then they are allowed to keep their membership and then they do something stupid to themselves and blame the forums.


If the entity that someone could target in a law-suit can be found to be negligent then it may become liable. I think that the rules and current rate of enforcement is sufficient to avoid being found negligent. At the end of the day anyone here can be underrage and be an excellent poster or be a 40 year old Columbian herion addict with bad English.Until they confess, there isn't a definite way of knowing (or is there?). I don't think it is necessary to spend more energy on suspicion.

I studied commercial and tax law at university as part of my undergrad and postgrad degrees but these are commerce related degrees not an actual law degree (major difference), so you only learn the basics of commercial law. Commercial law applies to the issue here. I would personally consult a lawyer about this if I was worried in the least. A consultation for this issue in Sydney would take up to 30 mins and would set me back $100-200 AUD (USD$90-180).
If you get legal consultation and follow teir instructions and then get sued, you an sue the legal adviser in-turn.

Actually, as screwed up is it may sound I am glad it happened. It made me work towards getting pussy not towards finding my soul mate etc. Soul searching is somethinf I have learned to put on the back burner. My relationships these days are mostly physical on my part, though the chicks have more often then not "fallen". I, like all of us on theese forums, have a weapon or tool and a skill that I woud like to showcase. To many women.

Here's why I think he didn't come back:
1. His post count was reset, so that when he turned 18 and was unbanned, he couldn't have his old post count back.
2. The hypocritical treatment of him in relation to the bugkahuna, who was also underrage and "admitted it" (in a post, he didn't start his own thread), only after I publicly outed him on the forums (http://www.cheekycherry.com/ccforums/showthread.php?t=1511&highlight=goliath)

He was a great guy and friend, contributed to discussions and helped other members, was ethical (as shown by his willful admission of being underrage), he was almost always very well mannered and respectable on these forums, articulated his arguments as best he could and was patient. In other words, aside from being underrage, he was the sort of member any forum needs to better itself, or the sort of member that people can benchmark from.

He was banned once he admitted to being underrage. He returned when he was 18, but was further punishment, something not stipulated whatsoever in the rules, he was denied his old post count. So the forums benefitted from his efforts, and then denied him any credit.

I am not surprised that he left, and I think the whole approach to him by the admins/mods after he turned 18, as opposed to their treatment of 'thebugkahuna' was a shambles and a stain on this forum's past.

I must admit, I don't know if the idea of not giving his old post count back was in any way related to my post in that (http://www.cheekycherry.com/ccforums/showthread.php?t=1511) thread. I was just joking... I swear it was just a joke. But on the other hand, I couldn't influence any of the mods or admins because now I know they wouldn't give a shit about me.

Just another thing, if he was to be given his old post count back, it would imply that an underage can register as a member of a strictly over 18 Penis Enlargement forum (the legal implications for that can be very serious), have a post count which reflects his vast access to a content forbiden by law for underage, come back after publicly admitting being underage and receive the post count which reflects his breaching of the law. This fact in a court of law would be used as enough evidence that the Admin of this forum connive with the fact that he was in serious infringement of the law.

What you have said in these two paragraphs actually supports my argument:
thebugkahuna made the bulk of his posts when he was underraged. Did any of his underrage posts get deleted from his post count?? If anyone should have had their post counts deleted it would have to be bug, not goliath, as bug was never banned from the forums. So Goliath was punished doubly while bug wasn't at all.

The reason I say that this is a stain on the forum's past is that if we have rules, they should be applied consistently and uniformly to all members. If a new member is interested in investing his time into a forum, I think he may be deterred when he stumbles onto these sorts of incidents.

It was artee who publicly made the decision to remove the post count. But since he was a mod, his decisions were the forum's decisions.

Matt, as far as I understand him, is looking to protect himself legally while providing a forum for others, which is extremely understandable.

But if someone wants to sue this forum, they will, full stop. No disclaimer will prevent someone from launching a lawsuit against the owner of this forum if they feel like it. And whether or not that lawsuit is successful, substantial legal costs would need to be incurred by both sides, and even if the owner of this forum succeeds to win the law suit, it is not a sure thing that he will recover any, let alone all, his attorney's fees.

And that applies to anything in life. Zw, you could get a letter tommorrow from an attorney's office informing you that a lawsuit will be launched against you for raping a woman on the street. Even though it never happened, she can still launch a suit against you although she will almost certainly lose. It doesn't mean that you wont have to incur your own legal fees, that you may not recover in full, as well as spend a lot of time with a lawyer and in court.

So the disclaimer, as well as proof that the rules are actually enforced, is enough to show that the owner of the site makes reasonable efforts to remove all underrage members from the site. But bug has broken the rules in the past, and no punishment is forthcoming, while goliath receives a strange extra punishment that has nothing to do with the rules.

So it becomes an issue of ethics - one law for some, and another law for others.

By the way Matt, since -I assume - you are interested in protecting yourself (as would anyone in your position be), maybe you could add the "no under 18's" rule to the disclaimer that needs to be agreed upon prior to registration. I just checked it out and it seems to be missing from it.

I agree with you wern. I think that all Kahuna's posts while underage should be deleted. Probably nobody could be bothered to even consider that possibility. Plus the fact that either a mod or an admin would have to figure out the dates of those posts in question.

I feel really sorry that good members like Goliath didn't wait until the lawful age to join the forum. A scenario like this (as unlikely as it may seem) can happen, and because of a great member, everyone would eventually lose. Therefore I agree with the punishment. I don't see how they can force Matt to do that without launching a lawsuit. And someone would have to be both wealthy and have time on their hands to launch an international lawsuit. I doubt the parents of some kid who wants to enlarge his penis would be willing to do that. Nor would they for a child vewing porn. So realistically the chances of someone doing that are about the same as the chances for an adult to try and force Matt to shut the site down. The disclaimer doesn't reduce the probability of a child's parents launching international action over that of an adult launching international action.
